Landlord Business Registration Forms Coming Soon; Registration Deadline Extended
Downloadable forms for Landlord Registration with the Board of Inland Revenue (BIR) will be available from 1st March, 2026. This was announced by the BIR this week, as it advised that preparations are well underway to facilitate landlords seeking to become compliant.
In a Media Release today (Friday 6th February, 2026), the Ministry of Finance said the BIR is “currently involved in administrative preparations to ensure readiness for implementation of the Landlord Business Surcharge — a new tax introduced in the 2025/2026 National Budget.”
Minister of Finance, Davendranath Tancoo, met with the BIR this week to discuss the new measure.
According to the Ministry, “As indicated in the National Budget 2026, all landlords are now required to register with the BIR. Landlords now have up to May 30 to get registered, following an extension of the timeframe from an earlier deadline of March 31.”
For an individual, the revised penalty for not filing taxes (Landlord Business Surcharge) is $1,000 for every six (6) months they are late. Corporations (Limited Liability Companies) incur a higher cost of $2,500 for every six (6) months that they lapse.
Minister Tancoo indicated that the extended deadline ensures landlords have sufficient time to get their house in order and enables as many landlords as possible to register.
“This also reduces the potential for rushed registration closer to the deadline,” Minister Tancoo said, adding that “the Surcharge is minimal at between 2.5% to 3.5% of rental income, while there are fines for not registering and paying taxes. We therefore implore landlords to become compliant and avoid being penalized.”
Minister Tancoo noted the Landlord Business Surcharge is now creditable to your final annual tax liability and as a result, is not a double tax.
In October 2025, when the Landlord Business Surcharge was introduced, the Ministry said the tax is based on actual rental income and will serve to “broaden the tax revenue base, promoting fairness, transparency and accountability.”
This measure requires all landlords to register with the BIR and pay a one-time registration fee of $2,500.
The surcharge will be applied as follows:
- 2.5% of the gross annual rental income of $20,000 or less; and
- 3.5% of the gross annual rental income exceeding $20,000.
The Landlord Business Surcharge is expected to yield a minimum of $70 million from the one-time registration fee.
